Beginning with the 2013 Porsche Cayenne, Porsche launched a “clean diesel” campaign to sell cars with a diesel engine that it advertised as both eco-friendly and fuel efficient, while maintaining its sports car like performance and only moderate exhaust emission values. Many consumers purchased the vehicles because they thought they were making an environmentally-responsible decision, as the cars were marketed as offering fuel efficiency while emitting low levels of pollutants.
However, Porsche’s “clean diesel” cars have now been determined to be anything but clean. On November 2, 2015, the United States Environmental Protection Agency (“EPA”) issued a “Notice of Violation” to Porsche alleging that Porsche developed and installed “defeat devices” in the Porsche Cayenne Diesel vehicles to bypass fuel emissions controls and installed “switch” devices to bypass EPA compliance testing. In other words, when driven in the real world, Porsche Cayenne Diesel vehicles emit excessive and illegal amounts of pollution; yet, these vehicles still passed the emissions tests.
