The CEMEX class action lawsuit complaint alleges that throughout the class period Defendants issued materially false and/or misleading statements and/or failed to disclose that: (i) CEMEX executives had engaged in an unlawful bribery scheme in connection with the Company’s business dealings in Colombia; (ii) discovery of the foregoing conduct would likely subject the Company to heightened regulatory scrutiny and potential criminal sanctions; (iii) the Company lacked adequate internal controls over financial reporting; and (iv) as a result, CEMEX’s public statements were materially false and misleading at all relevant times.
